GENERAL TERMS AND CONDITIONS OF SALE
These General Terms and Conditions of Sale (hereinafter referred to as the "GTCS") govern all orders placed on the www.artalisticcurated.com (hereinafter the "Site") operated by SO ART & Co, SLUThe company is registered in Andorra and governed by Andorran law, with its registered office at Carretera del Forn, Ed. El Bosquet II, AD100 Canillo, Principality of Andorra, and can be contacted by email at contact@artalisticcurated.com.
By placing an order on the Site, the Customer acknowledges that he/she has read and unreservedly accepts all of these GCS. The version applicable to any order is that in force on the Site at the time the order is validated. SO ART & Co, SLU reserves the right to modify the GTC at any time. The GTC applicable to an order will be those displayed at the time of validation.
I. THE CUSTOMER
The Customer declares that he/she is a natural person of at least 18 years of age and has the legal capacity to enter into a contract. In the event of an order being placed on behalf of a legal entity or a company, the Customer certifies that he/she has the necessary authorisations from the said entity.
It is the Customer's responsibility to provide accurate and complete information when registering and placing their order. In the event of inaccuracy in the delivery details, SO ART & Co, SLU cannot be held responsible for the impossibility of delivering the product(s) ordered.
II. PRODUCTS AND SERVICES
The products offered for sale on the Site include, but are not limited to:
- Works of contemporary art
- Support services (advice, tailor-made support for artists, professionals, entrepreneurs, the self-employed and private individuals, etc.).
- Ancillary services (event organisation, vernissages, leasing, tax exemption operations, etc.)
Each product or service is presented with the utmost care. However, we would like to point out that SO ART & Co, SLU does not guarantee the absolute accuracy of the descriptions, illustrations or technical references published on the Site. The Customer expressly acknowledges that non-substantial errors may appear in these presentations.
III. ORDERING
- Order procedure
Orders are placed via the online procedure provided on the Site. The Customer must follow the various steps involved in validating the order and ensure that the information entered is correct (personal details, delivery address, order details, etc.). - Formation of the contract
Validation of the order by the Customer implies unreserved acceptance of these GTS and constitutes a binding sales contract between the Customer and SO ART & Co, SLU. - Confirmation
A confirmation email, summarising in particular the items or services ordered, the quantities, the prices and the delivery address, will be sent to the Customer. This summary, together with the invoice provided at the time of delivery or electronically, will constitute proof of the transaction. - Refusal to order
SO ART & Co, SLU reserves the right to refuse any order for any legitimate reason, particularly in the event of an anomaly in the information provided or a history of disputes relating to previous payments. In such a case, the Customer will be informed by email.
IV. PRICES AND TERMS OF PAYMENT
A. Determination of the Price
- The prices displayed on the Site are indicated in euros, inclusive of all taxes, excluding delivery costs and, where applicable, other ancillary costs.
- The total amount of the order, including all taxes and additional charges, is specified in the order summary before validation.
- SO ART & Co, SLU reserves the right to modify its prices at any time. However, products or services will be invoiced on the basis of the prices in force at the time the order is placed, subject to availability.
- IMPORTANT: For all orders shipped outside the EU, the customer will be responsible for any import duties or taxes charged by customs and any carrier related charges. Any additional charges will be collected from the customer by the chosen carrier at the time of delivery.
B. Terms of payment
- Orders must be paid for in full by credit card or bank transfer at the time of confirmation.
- For credit card payments, the Customer will be redirected to a secure payment area that complies with PCI-DSS standards, guaranteeing the confidentiality and security of their financial information.
- The provision of payment details by the Customer shall constitute acceptance of the debiting of his/her account for the total amount of the order.
V. DELIVERY
- Terms and conditions
The works and services ordered will be delivered to the address indicated by the Customer when the order was placed. It is the Customer's responsibility to check that this address is correct and complete. - Deadlines
Delivery times are given for information only and correspond to average processing and dispatch times. SO ART & Co, SLU cannot be held responsible for delays in delivery due to circumstances beyond its control. - Reception
On receipt, the Customer must check the condition of the package and the products delivered. In the event of any apparent damage or non-conformity, the Customer must immediately inform the carrier by all available means and report any reservations upon receipt of the package. The Customer must also contact SO ART & Co, SLU by email within 3 days.
VI. RETURNS, EXCHANGES AND CANCELLATION
- Right of withdrawal
- For customers who are natural persons, a right of withdrawal of 14 days from the date of receipt of the products applies, except for works of art made to measure or any personalised order, for which this right cannot be exercised.
- To exercise this right, Customers must notify their decision by email to contact@artalisticcurated.com and follow the instructions given by SO ART & Co, SLU.
- Return policy
- Items must be returned in their original condition, complete (original packaging) and accompanied by a copy of the purchase invoice.
- The cost of returning the goods shall be borne by the Customer.
- Refunds, where applicable, will be made within 14 working days of receipt and verification. The company will SO ART & Co, SLU reserves the right to refuse an exchange, credit note or refund if the work is damaged after return and receipt.
- Exchanges and complaints
In the event of a defective product or a product that does not conform to the order, the Customer should immediately contact SO ART & Co, SLU in order to arrange an exchange or credit note, under the conditions specified by our services.
VII. APPLICABLE LAW AND JURISDICTION
These GCS are governed by Andorran law.
In the event of a dispute relating to the interpretation or performance of these GCS, the parties undertake to seek an amicable solution. In the absence of an amicable agreement, the dispute will be submitted to the competent courts of Andorra, which will have exclusive jurisdiction, even in the event of multiple defendants or the introduction of third parties.
VIII. LIABILITY
SO ART & Co, SLU endeavours to provide reliable and up-to-date information on the Site. However, the company cannot be held responsible for :
- Errors, omissions or inaccuracies on the Site
- Direct or indirect damage resulting from the use or inability to use the Site, including loss of data, interruption of service or external attacks.
- Any delay in delivery due to circumstances beyond its control
The responsibility of SO ART & Co, SLU is, in any event, limited to the normal performance of the sales contract.
IX. PROTECTION OF PERSONAL DATA
The personal information collected when an order is placed is processed in accordance with the Privacy Policy accessible on the Site. This data is used exclusively for order management, commercial relations and, where applicable, the sending of promotional information (only with the Customer's prior consent).
In accordance with the applicable legal provisions, the Customer has the right to access, rectify and object to data concerning him/her, which he/she may exercise by contacting SO ART & Co, SLU at contact@artalisticcurated.com.
X. FINAL PROVISIONS
- Modification of the General Terms and Conditions
SO ART & Co, SLU reserves the right to modify or adapt these GTC at any time. The version applicable to an order is the one published on the Site at the time the order is validated. - Partial nullity
If one or more of the provisions of these GCS should be declared null and void or inapplicable, the other provisions shall remain in force.
By validating his/her order on the Site, the Customer expressly declares that he/she has read and accepts these General Terms and Conditions of Sale in their entirety.
